Preamble

These terms and conditions are entered into between, on the one hand, CACHE CŒUR SARL, with a share capital of €37,000, whose registered office is located at ZI de Kerscao, Rue Jean Fourastié, 29480 Le Relecq-Kerhuon, France, registered with the Brest Trade and Companies Register under number 502 110 034, hereinafter referred to as “CACHE CŒUR”, and, on the other hand, any natural person acting as a consumer wishing to make a purchase on the website www.cachecoeur.com, hereinafter referred to as the “Buyer”.

These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with the distance sale of products offered by CACHE CŒUR.

The website www.cachecoeur.com is reserved for consumers acting for non-professional purposes.

Any order placed on the website implies full and unconditional acceptance of these General Terms and Conditions of Sale.

Article 1 - Scope

These General Terms and Conditions of Sale apply to all sales concluded between CACHE CŒUR and the Buyer via the website www.cachecoeur.com.

They are accessible at any time on the website and shall prevail over any other version or conflicting document.

The website www.cachecoeur.com is intended exclusively for consumers. Any order placed in the course of a professional activity or for resale purposes is prohibited.

Article 3 - Products

The products offered for sale are those displayed on the website on the day it is consulted by the Buyer, subject to availability.

Each product is accompanied by a description presenting its essential characteristics in accordance with consumer protection regulations.

Photographs, visuals, videos, and illustrations displayed on the website are provided for informational purposes only and have no contractual value. Minor differences in color or presentation may occur depending on the screen used.

CACHE CŒUR strives to ensure the accuracy of the information published on the website, but cannot be held liable for any errors or omissions that do not affect the essential characteristics of the products.

Article 4 - Product Availability

Products are offered for sale while stocks last.

If a product becomes unavailable after the order has been confirmed, CACHE CŒUR will inform the Buyer as soon as possible.

The Buyer may then:

  • Accept a delayed delivery;
  • Accept an equivalent product when available;
  • Request cancellation of the affected order;
  • Request reimbursement of amounts already paid.

Reimbursement shall be made within a maximum period of fourteen (14) days from validation of the request.

Article 5 - Prices

Prices displayed on the website are expressed in euros (€), inclusive of all taxes (VAT included).

Applicable shipping costs are indicated before final confirmation of the order.

CACHE CŒUR reserves the right to modify its prices at any time. However, products will be invoiced on the basis of the rates in force at the time the order is confirmed.

Products remain the property of CACHE CŒUR until full payment of the purchase price has been received.

Article 6 - Orders

The Buyer selects the products they wish to purchase and adds them to their shopping cart.

In accordance with Article L.221-5 of the French Consumer Code, before final validation of the order, the Buyer is provided with all mandatory pre-contractual information relating to the products, prices, delivery costs, and terms of contract performance.

Before final confirmation, the Buyer may review the details of the order, its total amount, and correct any errors.

The order becomes final after:

  • Validation of the shopping cart;
  • Acceptance of these General Terms and Conditions of Sale;
  • Confirmation of payment.

An order confirmation is then sent to the Buyer by email.

CACHE CŒUR reserves the right to refuse or cancel any order, particularly in the event of:

  • Fraud or attempted fraud;
  • A previous payment dispute;
  • Manifestly inaccurate information;
  • Abusive use of the service.

Article 7 - Secure Payment

Orders must be paid in full at the time of order confirmation.

The following payment methods are accepted on the website:

  • Credit Card (CB, Visa, Mastercard);
  • PayPal;
  • Alma (payment in installments subject to eligibility).

Transactions are secured through CACHE CŒUR’s payment service providers using security protocols that comply with market standards.

CACHE CŒUR never has access to customers' complete banking details and does not store them.

Payment in Installments with Alma

Customers may benefit from installment payment solutions offered by Alma, subject to eligibility and approval by Alma.

Installment payments are governed by Alma’s terms and conditions, which may be consulted directly with the provider.

Any financing refusal or payment incident may result in cancellation of the relevant order.

Installment payment options are available according to the conditions displayed on the website at the time of ordering.

Article 8 - Pre-Orders

Certain products may be offered on a pre-order basis.

The indication “Pre-Order” together with the estimated shipping date is displayed on the relevant product page.

Pre-order products must be paid for in full at the time the order is placed.

The communicated shipping date is indicative only and may change due to manufacturing, supply chain, or transportation constraints beyond CACHE CŒUR's control.

In the event of a significant delay, the Buyer will be informed as soon as possible.

When an order contains both immediately available products and pre-order products, shipment will be made once all ordered products are available.

All other provisions of these General Terms and Conditions of Sale remain applicable to pre-ordered products.

Article 9 - Shipping and Delivery

Delivery within Metropolitan France

CACHE CŒUR notably offers the following delivery methods:

  • Colissimo Home Delivery or Pickup Point
  • Express Home Delivery

Delivery times indicated on the website correspond to the timeframes usually observed by the carriers.

For Metropolitan France:

  • Colissimo: generally 2 to 3 business days after shipment;
  • Express: generally 24 hours after shipment for orders validated within the deadlines indicated on the website.

Delivery within the European Union

Delivery times vary depending on the destination country and the selected shipping method.

Delivery Outside the European Union and French Overseas Territories

Delivery times may vary according to customs procedures and applicable local regulations.

For deliveries outside the European Union, customs duties, local taxes, or import fees may be required by the authorities of the destination country.

Such fees remain the sole responsibility of the Buyer.

CACHE CŒUR reserves the right not to offer delivery to certain destinations for logistical or regulatory reasons.

Receipt of Parcels

The Buyer is required to inspect the apparent condition of the parcel and products upon receipt.

Any visible anomaly (missing product, damaged parcel, or damaged product) must be reported as soon as possible to the carrier concerned and to CACHE CŒUR Customer Service.

Transfer of Risk

In accordance with Article L.216-4 of the French Consumer Code, the risk of loss or damage to the products is transferred to the Buyer when the Buyer, or a third party designated by them, takes physical possession of the products.

Where the Buyer chooses a carrier other than the one proposed by CACHE CŒUR, the risk transfers when the parcel is handed over to the chosen carrier.

Article 10 - Right of Withdrawal and Returns

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Buyer has fourteen (14) days from receipt of the products to exercise their right of withdrawal without having to provide any reason.

To exercise this right, the Buyer must notify CACHE CŒUR of their decision before expiry of the legal withdrawal period.

Products must be returned within a maximum period of fourteen (14) days following notification of the withdrawal decision.

Return shipping costs remain the responsibility of the Buyer. For returns made using solutions offered by CACHE CŒUR within Metropolitan France, a fixed contribution of €5.95 may be deducted from the refund, unless otherwise stated in a promotional offer displayed on the website.

In the event that a parcel is not claimed or collected within the time limits imposed by the carrier, return-to-sender costs amounting to €5.95 may also be deducted from the refund.

Returned products must be:

  • Complete;
  • In their original packaging whenever possible;
  • Unworn;
  • Unwashed;
  • Undamaged;
  • Accompanied by their original tags.

Any product returned incomplete, worn, washed, damaged, or showing signs of use may be refused.

Refunds of the amounts due will be made within a maximum period of fourteen (14) days following receipt and inspection of the returned products.

In accordance with Article L.221-24 of the French Consumer Code, CACHE CŒUR may delay reimbursement until the returned products have been effectively recovered or until proof of shipment has been provided by the Buyer, whichever occurs first.

Products Excluded from the Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.

For hygiene reasons or due to the nature of the product, the following items cannot be returned or refunded:

  • Nursing pads;
  • Curve Starter Kits;
  • Maternity tights;
  • Bolas;
  • Cache Cœur chains.

Any product returned incomplete, worn, washed, damaged, or showing signs of use may be refused and returned to the Buyer.

Article 11 - Legal Warranties

Products sold by CACHE CŒUR benefit from the legal warranty of conformity provided for under Articles L.217-3 et seq. of the French Consumer Code, as well as the warranty against hidden defects provided for under Articles 1641 et seq. of the French Civil Code.

Legal Warranty of Conformity

Consumers have a period of two (2) years from delivery of the product to obtain conformity of the goods in the event of a lack of conformity.

Consumers may choose between repair and replacement of the product, subject to the cost conditions provided by applicable legal provisions.

Consumers are not required to prove the existence of the lack of conformity during the twenty-four (24) months following delivery of the goods.

Warranty Against Hidden Defects

Consumers may decide to invoke the warranty against hidden defects in accordance with Articles 1641 et seq. of the French Civil Code.

In such a case, they may choose either cancellation of the sale or a reduction of the purchase price in accordance with Article 1644 of the French Civil Code.

Article 12 - Liability

CACHE CŒUR shall not be held liable for damage resulting from improper use of purchased products.

CACHE CŒUR's liability cannot be engaged in cases of force majeure as defined by French law and case law.

CACHE CŒUR shall not be held liable for temporary disruptions or interruptions of the Internet network or electronic communication services beyond its control.

Photographs, illustrations, and visuals displayed on the website are provided for informational purposes only and shall not give rise to liability in the event of minor differences compared with the delivered product.

Article 13 - Personal Data

Personal data collected through the use of the website and the placing of orders is processed in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation.

Purposes of Processing

Article 14 - Force Majeure

The performance of CACHE CŒUR's obligations may be suspended in the event of a force majeure event within the meaning of Article 1218 of the French Civil Code.

Force majeure includes unforeseeable, irresistible, and external events preventing the normal performance of contractual obligations.

If the force majeure event continues beyond a reasonable period, either party may terminate the affected order without compensation.

Article 15 - Consumer Mediation

In accordance with the provisions of the French Consumer Code, the Buyer has the right to use a consumer mediator free of charge for the amicable resolution of any dispute with CACHE CŒUR.

Before requesting mediation, the Buyer must first attempt to resolve the dispute directly with CACHE CŒUR Customer Service through a written complaint sent to:

Article 16 - Extended Producer Responsibility (EPR)

In accordance with Article L.541-10-13 of the French Environmental Code, CACHE CŒUR is registered with the eco-organization Refashion under the Extended Producer Responsibility (EPR) scheme for Clothing Textiles, Household Linen, and Footwear.

This identifier certifies that CACHE CŒUR complies with its regulatory obligations regarding the end-of-life management of products placed on the market.

Any environmental information provided on the website is based on the data available at the time of publication and may evolve in accordance with regulatory or technical developments.

Article 17 - Governing Law

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the competent courts shall be determined in accordance with the legal provisions applicable to consumers.

APPENDIX – STANDARD WITHDRAWAL FORM

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer has a period of fourteen (14) days from receipt of the order to exercise their right of withdrawal without having to provide any reason.
